A photographer reported me and want me to pay

Hi guys, I went on my business instagram profile today and found out one of the photos I reposted got reported because some photographer own it. Fair enough until here.

Now I found out he sent me an invoice for the price of the picture and charging hundreds of dollars for it. I used it only on my Instagram feed.

Is this serious do I have to pay him by law or because it's on Instagram I'm protected?

I wouldn't take care about it. When content is deleted due to copyright, Instagram notifies you and encourages you contacting the rights owner to reach an agreement to restore the deleted content. In this case the rights owner contacted you and, in order to restore the content, he's asking for money so there's no an agreement to restore the content. As the photo was deleted from your profile and it's not on it anymore, I guess there's no more infringement and you don't have to pay as you're not using the photo;)

I guess you have a repost account so, in order to avoid infringements, this it waht I do: Before posting any pic or vid I check the credits and I vist the profile of the rights owners to see if is open to reposts by checking the tagged posts. If I see the pic or vid I want to upload I presume he/she don't mind about reposts and I upload ALWAYS giving credits. May not be infallible but, for the moment, I had no problem with any photo or video:)
 
The photographer is verified and has around 200k followers and sent me this invoice by e-mail from his "company" and charging my instagram name. He can't know me from the page but he can search for my domain name and check for details I guess.
Does it matter and you still think I can ignore and nothing can happen? He wants me to pay $300. From your story I understand that this is some kind of a way of him trying to make money and some people fall for it?
Don't fall. Remove the pics and don't panic. Nothing he can do
 
He is not going to do a thing other then try quickly pressure you in to paying to see if you break.

just ignore as others have said he sounds as if he’s just chancing to see.

great idea though for quickly making a few bucks!!
 
Nobody is going to take you to court for 300 euro, especially if two two of you aren't from the same state (or country).
You sure? I know people that sued for $1, just to get the lawsuit.

OP, this might also be a scam. Can you find out if he made that picture?
 
There are thousands of accounts that repost other pictures and they dont seem to report having invoices for images they repost.
 
Ask for proof it is their photo.

This is an old trick and one that can be very, very lucrative.
Even if it is theirs I highly doupt they will do anything if the op is not in same country(this why I don't steal content).

just delete the photo and ignore him.. he cant do.. and no one gonna pay for lawyer to fight against just a one pic. just delete it bro...
 
First, you should not panic. Once you saw that he send you a message regards copyright and an invoice you should have deleted the post from your page silently and replied to him that there is no post like that. Nothing more nothing less. End of the chapter.
 
Sounds like you reposted, something he posted on social media. Then he cant do shit, this would only be a case if you steal it from his website and have a business insentive with it.
 
Happened to me a year ago... I reposted a picture on the account of the company I'm working for

I'd say a mix of all the responses above but in this order :

1. Does he have your identity ? If yes, go 2. If no, ignore him.
2. Do you live in the EU or USA ? If yes, go 3. If no, ignore him.
3. First, wait to see if you get a letter from a lawyer. If so, try to negociate the price. That's what we did, the guy was asking $1800 and we ended at $400...

There are tools crawling instagram accounts and looking for repost pictures of photograph. Once they find a repost, they send you a lawyer letter. So better be careful if you are not anonymous
 
I'm amazed that you even consider paying him or even wondering what to do. :D

Just delete the picture and ignore him he won't do shit.
 
some countries share the same copyright system. if your country and his country do not have such a treaty or agreement, you can ignore him completely and legally
