You can't do anything unless he is using a registered trademark in his address text. If he is using your brand as a keyword, that's conquest bidding and is totally acceptable. The only thing you can do is beat his ads.

Your budget is to low to see any results. Try the display network on specific placements or something.

Just set up the campaign/ads/keyword and set the bid low. Wait a day or so and just monitor the traffic. If you aren't getting any impressions or your average position is too low, raise the bid a little each time.
