ICANN can take the domain from you if you impersonate someone. If you "spin" the content and be smart about how you are writing in the site, I dont see how they can take it from you. But anyways, if you write new content, you also need to explain why you have a domain that match his exact name...

You can restore the content but with a spin on it. I dont mean to spin the content with a tool, I mean just rewriting some stuff, changing some titles, changing the design of the site, stuff like that so its not so obvious.

Make a list of the bad links that were pointed in your direction and disavow them with the google tool. If you are a new site you can be affected by this negative seo technique, if you are a bigger site its not very probable as google is smart and just simply dont count those bad links at all
