Yes, the bottom line is whether there is an intent to game the system for the purposes of manipulating the search engine ranking algorithm.
Cloaking and linking techniques can be effective in the short run, but they also come with clear risks of being penalized.

Black hat SEO is basically trying to rank by gaming the search engine rather than actually improving the site for users.

A few easy examples would be stuffing the same keyword everywhere, buying a ton of low-quality backlinks, hiding keywords on a page, or creating lots of thin pages just to target different searches.

It uses manipulative strategy like keyword stuffing, Hidden links and buying spammy links to rank there sites by violating google rules and guidelines. Though it brings fast rankings but it can result from being penalized by google.
