I have a client that we rebuilt their website and in the few weeks that we did not have the proper cookie consent system set up, a law firm Mou Law (in Anaheim) sued them. This law firm is a serial "suer". They have a few people 100s of miles from where we are that test websites and file lawsuits. My research says they often lose, but usually extort money from people who are freaked out. They are asking for $70,000 from a single contractor (small time) for using the Facebook Pixel and not having the proper cookie or GTM pixel deployment properly. I am doing the research now to beat them (thank you Manus) by finding all the times they have lost (several).
Separate from that, I want to punish these people! They scam small business owners out of $100,000s (or millions combined) in money. They scare people with these bogus claims.
The law firm is Mou Law. Mou Law PC / Attebery / Hill
Attebery & Hill are 2 serial plaintiffs that file tons of cases. They are the supposed victims of trying to use a website 100s of miles from where they live. Stacy Hill (the Hill plaintiff) primarily focuses on contractors of different sizes (mostly small, b/c legal cost is similar to what they want to settle for).
Any suggestions on how (beyond me helping my client, which my lawyer (who I paid $3k) told me NOT do do...distance yourself from them was their advice) to truly punish these people and their dirty deeds? I want to do it legally! I have some ideas, but would LOVE to hear from this group.
BTW, do a little research if you are in (or representing someone in) the U.S. and specifically California (sue happy capital of the world) in having the proper cookie and ADA scripts and functionality deployed (if you care about your clients). My research has found that there are a handful of lawyers filing TONS of these suits, and guess what, a handful of lawyers that will fight them, conveniently for the same amount that the first lawyer is suing for = total scam and disgusting IMO.
