    Default Marketing Question?

    I was able to get a email mailing list from a third party and I was wondering is there any way I can face fines (regarding Anti spam laws) for sending a season's greetings or New Years wish from my company to the emails. I will not be selling any product to them just a greetings.

    with email spam- sending out informative newsletters without a commercial intent is one way to send out mass emails. This is a grey area, so research this-
    time to play the game.

    So sending a newsletter with a happy new year greeting and (no commercial selling just company logo) is considered ok?

    from what I learned from some formal courses I took it is not considered spam- my instructor is a attorney by trade that consults on seo, email etc. again do your own homework or consult an attorney-
    time to play the game.

    yep i would still research this. I would just make sure that if you send something out that the people that you are sending the email to have a way to opt out of getting anything else from you.

    IMO just sending one email is not spam. But I am not the Fed

    The OP isn't asking if it's spam or not, the question is whether it's illegal under the spam laws like CAN-SPAM or not. All unsolicited bulk email can be considered spam by definition, but not all unsolicited bulk email is necessarily illegal. The various spam laws all give much narrower legal definitions for what spam would be considered illegal.

    If you're just going to be sending out the single mailing in this case as you described it then you might be ok. If you're confident in the provider of the list, I probably wouldn't worry about it myself. But that's just me.

    But even though it isn't a directly commercial email in which your trying to sell something, the simple fact that it's being sent from a company and includes your company information might be enough for the law to consider it commercial. If that's the case then it would fall under the guidelines of can-spam and other spam laws.

    The only way to really know for sure (if you really want to cover your ass) is to check with a lawyer that specializes in this type of thing.

    Risky. It could get your company's email classified as spam by a bunch of email filters (permanently).
