Just a heads up to anyone here doing a transaction with this scammer: M144L3.
He has failed to deliver what he has promised, and has ran away with my money.
He even lied to paypal that he has delivered the item in a dispute. Either deliver or refund the money you haven't earned. He doesn't even understand the simple definition of a "transaction", for he has the perception that its alright to run away with my money without delivering what he has promised in a contractual obligation.
Be aware and be careful.

A contractual obligation arises as a result of an enforceable promise, agreement, or contract. There was no promise, agreement OR contract.
I told you I'd provide the link when I returned from work, only to get home and realise that you had disputed with Paypal. I offered you the easy way or the hard way. You chose to lie to Paypal by saying it was 'boxed software' and that tracking was promised (Despite this being a digital product)
So clearly you'd prefer the hard way
So yeah, let's have some fun.

Refund his money.
Some people are just not worth the hassle and one if not both of you will end
up being banned.

Yeah, what you need to understand if you provide a service that no one has ever used of yours, is your credibility is 100% on the line. Some of us in IM take part in very expensive fishing trips daily.

He can't even prove to Paypal that he never received his download as it's an intangible item.
So no, he can't prove anything to anyone.

That is not the point.
You have already stated that he filed a dispute before you arrived home
from work.
Now He should either cancel the dispute and let you send him the link or
you should refund his money and have nothing more to do with him.
Come on you're in big school now!

Yes refund my money now. Any admin here can check my PM convo with him. Either refund my money or deliver what you have promised. Its that simple.
You obviously failed to deliver and don't have the item as you say you do. You've tried to prolong this multiple times. Here's your excuses:
1.) Okay, I'll let you know once I leave work
2.) It's currently 4am where I am though, so will have to do the transaction in a few hours as I'm on my way to work shortly.
3.) I said was on my way soon, not leaving.
4.) Been a busy day sorry. Finished work etc now, I'll send you a direct download link within the hour.
After more than 20 hours later, who will believe you anymore? Ofcourse anybody would open a dispute with paypal.
Now you haven't refunded my money at all and lies to paypal that you have delivered the item, when you simply obviously don't have it. If you want to still gain little credibility do either one of these:
Refund
Or
Deliver what you have promised.
However, I had enough with you so I already said yesterday to Forget it I don't want it anymore, just refund -- and you lie to paypal that you delivered already and escalate the claim using that reason?
It's only $75 and not much -- I don't care anymore since I don't want to deal with you anymore.
But please be responsible, and this thread was opened as a Fair Warning to everyone here.

mraz, what were you buying anyway? (you don't have to answer if you don't want to)
M144L3, why don't you just send him the link then, whatever it is? Or why not just refund? It really isn't that complicated.

M144l3 customer is always right, if you want any more business here, show all your potential customers how you deal with your actual customers.

I am surprised that the guy concerned has always been online without even responding now and make the refund as BigBuddy has instructed. I don't think he needs to wait for the end of the 2 days making making refund.

Re: Just got SCAMMED from member here: M144L3
since i taught contractual law in my pre-im life. a contract needs "consideration" to be legally enforced, a contract that cannot be enforced is still legal. a contract that is not legal is still a contract, but cannot be enforced. a contract requires a "meeting of the minds" as well. a contract can be verbal or written, a verbal contract cannot be enforced. a contract can also be accidentally created through oratory means such as an agent giving advice to a prospect and there-by creating a non-compensated "implied agency" agreement. yup, im bored, but tis true.

Re: Just got SCAMMED from member here: M144L3
Intresting post, most of us have had customers in which we would like to teach a lesson whether they really earned it or not, after all we are human. In some areas I must be slow as I did not pick up on the racist thing. The comment about newbies was worse to me, like we do not have integrity, treat people right, ethics, etc.
The people that made the comment that you are hurting your reputation with other customers that you would want, is true. This is not the place to teach your customer a lesson, true that this person was quick to attack with the posts but some customers are just that way, you do whatever you agreed to and then be done with them. Keep the good weed out the bad.

Since it has been 3 days after his last response to me, that proves he's just after my money. Before I paid, he told me the file is already on his server so he can provide me with the download link immediately -- its not like he has to do any work. So cmon, failing to provide a download link to a buyer after 20 hours when he said its already on his server? If that doesn't smell fishy to you, then you need to think logically and act appropriately after analyzing his behavior.
As a matter of fact, a transaction is a contractual obligation. By making that comment, the seller (M144L3) does not genuinely understand the meaning of transaction and has his eyes on my money from the start.
A contractual obligation arises as a result of an enforceable promise, agreement, or contract. There was no promise, agreement OR contract.
Really? no promise, no agreement? What the hell did I pay you for then?
I don't know what country you are from, but in US and Canada, an agreement to do a transaction by verbal or written means is contractually-binding and each party has to do his obligation to fulfill the contract. And yes, a contract is made as soon as agreement or "meeting of the minds" reached, even verbally and in non-formal way, and is enforceable legally.
So I am still waiting for your obligation. After 3 days now, why not fulfill it if you are indeed not a scammer?
I am not an impatient person, I just know how to better protect myself. If I don't act soon enough, who knows if he has transferred the money to his other paypal accounts or withdraw it---rendering the dispute worthless. Besides, the length of time in our written contract (download link in hour), was long reached, and it was only a due diligent and prudent thing to do.
Thus, he has failed three things:
1.) Fail to deliver within his promised time frame
2.) Fail to deliver his file to me, which he said already in his server, after 20 hours, and 3 days later.
3.) 3 days later, still nothing, he's been online here for couple days and not responding, and he never refund my money after reading BigBuddy's post.
If the above is not the behavior and characteristics of a scammer, then what is?
