1) If you're talking about free anon proxies on proxy lists, they're a mix of: misconfigured routers and corporate appliances, deliberately open proxies, botnets.
2) Yes, you will probably find botnet proxies if you are scanning.
3) No, there's not really any way you can tell if the proxies are from a botnet or not. Possibly you could look them up on one of the spam blocklists and use that as a guide. Possibly you could use the OS fingerprinting in nmap or other network mapping tools; if the host is running Windows, it's liable to be a compromised PC. But that's a lot of effort for not much return.
My advice: don't worry about it. Getting caught in a honeypot is way more of a problem than accidentally using a botnet proxy.
