Black Hat World Terms of Use
1. ACCEPTANCE OF TERMS
Black Hat World and its principal(s) ("Black Hat World" or "We") provide a collection of online resources including forums, web pages, and paid areas (referred to hereafter as "the Service") at www.BlackHatWorld.com (the "Site") to third parties ("You" or "you") using the Service and Site. By using the Service, you agree to the following terms and conditions, and any policies, guidelines or amendments thereto that may be presented to you from time to time, including but not limited to Program Policies and Legal Notices (collectively, the "Terms"). We reserve the right, at our sole discretion, to change, modify or otherwise alter the Terms at any time. Such modifications shall become effective immediately upon the posting thereof. You will be notified of any such modifications and the most current version of the Terms will be available at http://www.BlackHatWorld.com/terms.html.
2. CONTENT
You understand that all information, data, text, software, tools, photographs, graphics, video, messages or other materials (collectively, "Content") posted on, transmitted through, or linked from the Service are the sole responsibility of the person from which such content originated. Black Hat World reserves the right, but shall have no obligation, to pre-screen, flag, filter, refuse, modify or remove any C ontent available via the Service for violating the Terms or for any other reason. You understand that Black Hat World does not control, does not take part in creating or generating, and is not responsible for development of C ontent made available through the Service, and that by using the Service you may be exposed to C ontent that is offensive, indecent or objectionable, and that you use Black Hat World at your own risk.
Furthermore, the Black Hat World site and Content available through the Service may contain links to other websites, which are completely independent of Black Hat World. Black Hat World makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk.
You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will Black Hat World be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service.
You agree that you are responsible for your own conduct and any c ontent that you create, transmit or display while using the Service and for any consequences thereof. You agree to use the Service only for purposes that are legal, proper and in accordance with the Terms and any applicable policies or guidelines. To report any activity or c ontent that may violate the Terms, please send email to Abuse/at/BlackHatWorld.com so that Black Hat World may take reasonable action to remove such content. Note that Black Hat World does not guarantee that it will respond to or will take action in response to all such notifications.
Users outside of the United States agree to comply with their own local laws regarding online conduct and acceptable content.
3. PROHIBITED CONTENT / ACTIVITIES
Black Hat World may set guidelines for what may appear on the Site, but exercises no control over the Content of such forums and is unable to police all such Content, and makes no representations about its ability to enforce such guidelines.
As part of Black Hat World's guidelines, please be advised that Black Hat World does not encourage or promote any posts or discussions concerning unlawful activities, fraud, or deception, including posts or discussions relating to fraudulent activities such as Cookie Stuffing, "E-Whoring," PVA activities, or using classified ads in a deceptive manner.
Notwithstanding, in the overwhelming majority of instances, Black Hat World has no control whatsoever over the Site's Content, due to the volume of the Content and because the Content is posted from people over whom Black Hat World exercises no control. As such, Black Hat World cannot and does not screen each post before such posts appear on the Site, and Black Hat World makes no guarantees, representations or warranties of any kind, expressed or implied, about the Content provided on the Site. Accordingly, Black Hat World assumes no responsibility for the Content of the Site, including the content of any posts included in the forums or otherwise linked to the Black Hat World site or in any web page linked to a third party within the Black Hat World site.
If you have reason to believe that any Content pertains to discussion of unlawful activities, please inform Black Hat World team members at "Abuse/at/BlackHatWorld.com" so that Black Hat World may take reasonable action to remove such content. Note that Black Hat World will make a commercially reasonable effort to respond, but does not guarantee that it will respond to or will take action in response to all such notifications, and therefore cannot be responsible for a failure to respond.
The following are examples of of Content that is illegal or prohibited to post on, through or in connection with Black Hat World Services.
3.1 criminal or tortious activity, including, but not limited to Hacking, Botnets, Identify Theft, Carding (credit cards), Pharma stuff (prescription meds), Ponzi schemes, Cash gifting, Cookie Stuffing, Spamming techniques;
3.2 activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network
3.3 activity that involves, Currency Trades or Exchanges (Example: Exchanging PayPal for eGold money), Buying/Selling CPA accounts, Buying/Selling Social Security Numbers or Identities, CPA offer filling circles, Paying to have CPA offers filled, Requesting fake review comments for other forums' BST sections, Digg / Stumble (or similar) requests & trades, Asking how to make $xxx/day, Any "fake" account for the purposes of defrauding a network or individual, Promoting other forums by any means including in your signature, Creating more than one account on BHW;
3.4 engaging in, either directly or indirectly, or encouraging others to engage in, click-throughs generated through any manner that could be reasonably interpreted as coercive, incentivized, misleading, malicious, or otherwise fraudulent;
3.5 engaging in post count inflation by posting excessive amounts of short replies for the sole purpose of inflating your post count. This includes the infamous “thanks for the share.” . (If you’d like to say “thanks” to someone for their effort/contribution, make use of the Thanks button);
3.6 advertising to, or solicitation of, any m ember to buy or sell any products or services through the unauthorized or impermissible use of the Services such as PM solicitation. (If you have something you want to sell on this forum, post it in the For Sale section);
3.7 engaging in content that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
3.8 advertise any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by U.S law.
4. AFFILIATE LINKS
Affiliate links are only allowed in the Affiliate Programs section of the forum, or in your signature. This includes links to your websites or blogs which redirect to an affiliate link. If you wish to let people know about a new website or program, create ONE thread in the Affiliate Programs forum and provide detailed info about the program and include 2 links: one affiliate link and one non-affiliate link. You MUST give them the choice to sign up under you or not. Also, do not try to avoid our rules by making a post about an affiliate program you found, where you ask people to PM you for the info. This is no different than affiliate link spam. If we are notified of any violation of these rules, your affiliate link may be removed and an infraction or ban will be given at our discretion.
5. SIGNATURES
You must be a member of the forum for 30 days and have 50 quality posts before you will be allowed to use a signature on this forum. In order to use links or images in your signature, you need to be a Donor. You may post 2-3 affiliate links or 1 SMALL banner in your signature. Do not use a font size larger than 2, crazy fonts/colors, sound clips, excessive smileys, or anything else annoying. We reserve the right to change, delete or rearrange your signature as we see fit at any time.
6. COOKIE STUFFING
The discussion and or activities of cookie stuffing are STRICTLY PROHIBITED, including discussion or posting of scripts or tools pertaining to cookie stuffing.
7. THE REPORT BUTTON
If you find a post that appears to be in direct violation of the forum rules and terms of service, please report it to us by using the report button (the ! button). There is a report button next to every post, as well as in each PM that you receive. Clicking it will send an email to every Administrator and Moderator informing them of the post's or PM's location, so that so that Black Hat World may take reasonable action to remove such posts. Note that Black Hat World does not guarantee that it will respond to or will take action in response to all such notifications, but will make a commercially reasonable effort to take action. Using the report button has been shown to be an effective way to fight against spammers or people who are trying to cause trouble. If you just ignore it, it may never get addressed! Reporting a post is completely anonymous; the person you are reporting will not know who reported the post.
8. THE THANKS BUTTON
If you have found the information from another member useful or helpful, please make use of the Thanks button, instead of posting a reply that merely says “thank you". This helps us keep the forum clean and free of clutter, and helps to improve the other person's reputation on this forum. You may also use the Rep button (little scale) to give another user positive or negative rep as you fit, and can include a brief note to the other member.
9. iTRADER
iTrader is a member rating system, similar to eBay®'s feedback system. It allows you to leave a Positive, Neutral, or Negative rating for someone, based on their performance as a buyer or seller, after conducting a business transaction with them. iTrader ratings are viewable by the public, which allows you to view other member s' iTrader scores and judge whether or not you should conduct business with them.
Note: Black Hat World does not independently verify the accuracy of any iTrader ratings and is not responsible for any such ratings. iTrader is only to be used AFTER a business transaction has occurred. If you are considering leaving someone negative iTrader feedback, we suggest that you do all that you can to contact the other party and resolve your problems with them directly. Please be patient and remember that people have to sleep and cannot be online all the time. Do NOT abuse our iTrader system! Anyone leaving fraudulent iTrader ratings may be banned without warning if we are notified.
10. INFRACTION AND BANS
Although Black Hat World does not have the ability to police the Site, o ur administrators and moderators reserve the right to issue infractions or bans as they see fit. If you receive 3 infractions on this forum, it will result in a permanent ban.
11. POLICIES REGARDING COPYRIGHT AND TRADEMARKS
It is our policy to respond to notices of alleged infringement that comply with the United States' Digital Millennium Copyright Act or other applicable law and to terminating the accounts of repeat infringers. Uploading any copyrighted material to this site without the expressed permission of the copyright holder is prohibited. Do not try to use any sneaky tactics, or provide downloads that contains anything malicious such as Spyware, Adware, Warez, Viruses, Trojans, etc…, as this will only get your account banned if we are notified. Please check your uploaded files for viruses BEFORE uploading them by scanning them for free at jotti.org
If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have beenotherwise violated, please notify BlackHatworld's agent for notice of claims of copyright or other intellectual property infringement ("Agent"), at Abuse/at/BlackHatWorld.com
Please provide the following in your Notice:
a) Identify the material on the Black Hat World site that you claim is infringing, with enough detail so that we may locate it on the website;
b) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
c) A statement by you declaring under penalty of perjury that (1) the above information in your Notice is accurate, and (2) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner;
12. FOR SALE/SERVICES SECTION
We may charge a fee to post Content in some areas of Black Hat World. The fee is an access fee permitting Content to be posted in a designated area. Each party posting Content to Black Hat World is responsible for said Content and compliance with the Terms . All fees paid will be non-refundable in the event that Content is removed from the Service for violating the Terms . Use the For Sale and Freelance sections at your own risk. We are not an arbitration forum, and will not act as an intermediary between any person or parties. We cannot be held liable or responsible for any damages or losses of any kind that result from the use of this forum, its subsections, its members, staff, or transactions. However, we are interested in taking action, in our discretion, against any and all scams that we are notified of on this forum. All claims of fraud or scams must be substantiated with solid proof.
13. FEES
You acknowledge that Black Hat World reserves the right to charge for any portion of the Service and to change its fees (if any) from time to time in its discretion. If Black Hat World terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of fees or payments (if any).
14.1 Jr. VIP status. In order to gain entrance to the Jr. VIP area, you must be a member of the forum for at least 60 days, have at least 100 quality posts, and make a $97 annual donation to the forum. Jr. VIP membership gives you access to other forums which are NOT indexed by any search engines or viewable by any non Jr. VIP members.
14.2 Executive VIP. This section of the forum is available to our forum’s veterans only. In order to gain entrance to the VIP, you must be a member of the forum for at least 3 months and be nominated by another VIP member. Once nominated, you must then be voted on by all of the other VIP members. You must receive at least 51% of the votes in order to gain access. If you are a loner, or don't play well with others, then don't expect to make it into the VIP. If you wish to make into the VIP section one day, your best bet is to make it to the Jr. VIP section first and then stand out by being a helpful and productive member.
15. THE "SHITLIST"
If for some reason you are found to be a scammer or providing the forum with dishonesty in regards to lying about products, reviews, testimonials, earnings, or anything scammish in nature, you will find yourself in the "S hitlist." If you find yourself or a product of yours in the "S hitlist" and wish to redeem yourself and be removed, you may contact an Administrator or Moderator and explain your story. An Administrator or Moderator will make a commercially reasonable effort to contact the parties involved and it will result in one of two things: Either you/it will stay there, or you/it will be cleared and removed. Black Hat World disclaims all liability for any actions or omissions in connection with the "Shitlist." If you do not reply to the "S hitlist" thread, you will stay there indefinitely. Anyone caught abusing t he Shitlist, or falsely accusing someone or something worthy of a place in t he Shitlist, may be infractioned and/or banned as we see fit.
16. THIRD PARTY CONTENT, SITES, AND SERVICES
Black Hat World may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of Black Hat World, including web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole.
Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.
You agree that Black Hat World shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Black Hat World is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Black Hat World, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service. If you are a California resident, to the extent permitted by applicable law, you waive any rights that you may have under California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
The Service is supported in part by advertising revenue and may display advertisements and promotions on the service. The manner, mode and extent of advertising by Black Hat World on its services are subject to change. As consideration for your use of the Service, you agree that Black Hat World may place such advertising and that Black Hat World shall not be responsible or liable for any loss or damage of any sort incurred by you as a result of the presence of such advertisers on the Service or your subsequent dealings with advertisers.

Your use of the Black Hat World Site or the Service signifies acknowledgement of and agreement to our Privacy Policy. You further acknowledge and agree that Black Hat World may, in its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the Terms ; respond to claims that any Content violates the rights of third-parties; respond to claims that contact information (e.g. phone number, street address) of a third-party have been posted or transmitted without their consent or as a form of harassment; protect the rights, property, or personal safety of Black Hat World, its users or the general public.
18. TERMINATION
You may discontinue your use of the Services at any time. You agree that Black Hat World may at any time and for any reason or no reason, including a period of account inactivity, terminate your access to the Service, terminate the Terms, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to the Service, your account or any files or other content contained in your account. These sections of the Terms shall survive expiration or termination.
19. PROPRIETARY RIGHTS
Black Hat World does not claim any ownership rights in the text, files, images, works of authorship, applications, or other materials (collectively, "Third Party C ontent") that its users post. B y posting Third Party Content to any public area of the Service, you automatically grant, and you represent and warrant that you have the right to grant to Black Hat World an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute said Content and to prepare derivative works of, or incorporate into other works, said Third PartyContent, and to grant and authorize sublicenses (through multiple tiers) of the foregoing. Furthermore, by posting Third party Content to any public area of the Service, you automatically grant Black Hat World all rights necessary to prohibit any subsequent aggregation, display, copying, duplication, reproduction, or exploitation of the Third Party Content on the Service by any party for any purpose.
20. RELEASE
By agreeing to the Terms you hereby acknowledge , that "You", on behalf of yourself and any partners, members, operators, managers, affiliates, subsidiaries, predecessors, successors, assigns, admins, officers and the partners and affiliates of its partners, members, operators and managers (collectively, the "Releasors"), hereby irrevocably and unconditionally release and forever discharge BlackHatWorld.com, its affiliates and each of its beneficiaries, trustees, owners, predecessors, successors, assigns, admins, agents, officers, directors, shareholders, employees, Site administrators, servicers, representatives, attorneys, and affiliates, and all persons acting by, through, under, or in concert with any of the aforesaid persons ,or entities or persons, (collectively, "Releasees"), from and against any and all liability , and from and against any and all causes of action, including any and all suits, covenants, contracts, agreements, debts, liens, obligations, liabilities, claims, demands, damages, judg¬ments, executions, losses, orders, penalties, costs and expenses, including, without limitation, attorneys’ fees, of any kind or nature whatsoever, known or unknown, suspected or unsuspected, fixed or contingent, liquidated or unliquidated, which any of the Releasors ever had or now have or hereafter may have, whether in law or in equity, based upon, or related to, whether directly or indirectly, to the Services or use of the Site.
21. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
1. YOUR USE OF BLACK HAT WORLD AND THE SERVICE IS AT YOUR SOLE RISK. BLACK HAT WORLD SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACK HAT WORLD AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
2. BLACK HAT WORLD AND PARTNERS DO NOT WARRANT THAT (i) BLACK HAT WORLD SERVICES WILL MEET YOUR REQUIREMENTS, (ii) BLACK HAT WORLD SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF BLACK HAT WORLD SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH BLACK HAT WORLD SERVICES WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF BLACK HAT WORLD SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
4. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BLACK HAT WORLD OR THROUGH OR FROM BLACK HAT WORLD SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
IF YOU DO NOT UNDERSTAND OR AGREE WITH ANY OF THESE TERMS OR CONDITIONS, DO NOT REGISTER ON THIS FORUM. BY REGISTERING ON THIS FORUM, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL OF ITS PROVISIONS .
