I got an email from paypal today saying there was a dispute against me. The bitch that filed it, says she never received the item she paid for. This is bullshit because I don´t sell anything or ship anything in any way, shape or form. The truth of the matter is, this bitch has a personal grudge against me.

To explain what happened... I have a membership website, all adult content I produced and paid for myself, I paid for a designer, CMS, domain, hosting etc... 100% myself, 100% owned by me. I needed someone to run and promote the site. I made an agreement with this bitch to run the site for me and as she had a credit card processor, she would hook up her credit card to my site for members to join. I said I´d give her 50% of the sign ups. That was 6 months ago.... and in that time, she only managed 4 sign ups.

She would subtract the credit card fees and send me my cut by paypal. In the meantime, I´m losing money on the fucking site, paying for hosting so I decided to sell the site. When I said this to the bitch, first of all she was disappointed, then she emailed me out of the blue and claimed she owned 50% of the site and wanted half of the sale price. I basically told her to go and fuck herself and changed the passwords. She said she was going to sue me and the new owner and contact all the review sites... all bullshit threats, I´m not even in the USA, she doesn´t even know my name and address... I told the new buyer and thankfully he still wants to buy the site, so her sabotage act didn´t work.

Now she says she wants to be paid for the work she did. The whole agreement was she would get 50% of the signups, from traffic she would generate. She did a shitty job, 4 signups, so she made fuck all... we both lost. She should be thank full to me for bringing an opportunity to her to make money, with zero investment from her. Anyway, to get to my point, the bitch claimed against me in paypal... and just said she never received items she paid for... complete rubbish.

But I read that if I can´t show a receipt of some sort, she will win. I rang paypal and they told me to ignore the claim, but if she (and she will) escalate the claim, then I will lose as I can´t show a receipt of shipment. She understands how paypal works, so I´m screwed. But I´m wondering if there is no shipping address in the payment she sent, how the fuck can she win... should I answer her back? There isn´t much money at stake here, but its the principle of the matter that bugs me. Can I make some fake receipt, fight fire with fire... talk to someone else in paypal? If thats the case, where anyone can just claim a dispute in paypal saying they didn´t receive an item, when there was no item involved... and they win automatically, then paypal sucks ass. There must be something I can do?

Yes, I would be as truthful as possible in the email and if a payment dispute is opened up. Ultimately it will be up to paypal and perhaps her credit card company (if she does a dispute) to decide. There really is nothing you can do.

In all honesty what are we talking about here, probably <$100 or so. You should be thankful that you sold the website, I am assuming for a profit, and move on and not waste anymore time on this clown.

She sent me money through paypal, which was my cut of the profit.
Now I get an email from paypal:
bitch666@hot.... has opened a dispute over the payment made to you on
Feb 8, 2010 indicating that they never received the item.

Paypal themselves told me to ignore it and hope she won´t escalate the claim. I don´t want to reply if it will screw up any chances of finding another solution... there was no shipping address... I wonder could I just say it was shipped, and enter in a recent fedex or UPS number I sent to the USA, which was delivered?
Just an idea. And yes, its not for much money, but as I said, its the principle. Also, she sent money through paypal just a few days ago, worth more, and no claim has been made yet. Maybe she´s seeing what kind of game I´ll play with this claim.

Depends how she flagged the money when she sent it to you. Did she mark it as money owed/gift etc?

Also did you provide a reciept/invoice to her stating what the money was for?

I don´t know how she flagged it, and I can´t seem to find out what she flagged it as inside the paypal account. Is there a way to find out? I didn´t send any receipt/invoice.

Don't ever lie to paypal, that will screw you in the end..... If there was no signing of contracts or anything of the like, then don't worry about it.... Explain that there was no reason for her to be filing a dispute or claim as it may end up being, because the product was delivered electronically. There is no record of delivery because of such. Therefore, if this was, and you are claiming it to be such, there was no "tangible good" to be delivered... That should help you in your claim.... And possibly win it if you are truthful and patient... If she makes a chargeback on her cc, if she paid via one, that could take up to 6 months.... I just got my money back from a chargeback last week and it was in nov/dec 2009 when it was placed..... So yeah... Good luck

I´m not lying to paypal or anyone. This girl is a nut job, and just got pissed with me because I wouldn´t see eye to eye with her, and hoped I would buckle if she threatened a lawsuit. She doesn´t have a leg to stand on... apart from the fact that she is totally in the wrong. Also, not sure how close you guys actually read my post... but I did not deliver or claim to deliver any product, electronically or in any format... there was none... its a payment she made to me, my cut... now claims it was something else.

GayPal will lie through their teeth to you so believe nothing they say. I had a similar thing and called them to head the beeatch off at the pass. They agreed with me and told me not to worry about it. When she escalated it went to a new bunch of d-bags who didn't give a crap what the first guy said.

If she said the payment was for a service you might have a chance. If it was 4 different transactions you'll have a better shot at winning. Good luck man!

Maybe you could copy-paste the original conversation/agreement that you had with her. Maybe the email chat ( best if her paypal email id and the email id she used to chat with you or email you were the same ).

Sending paypal the conversation can help you win the dispute. Paypal gets hundreds of such cases each day and when it is escalated .. they require you to produce any conversation or emails you might have exchanged with the person.
