I am not sure this is the correct place to ask this question, if moderator think so please place it in correct category.

I bought 1 rayban wayfarer from seller 'nm18789', I received item after 40 days and when I checked item it was not original rayban wayfarer, its a copy from china. I sent her many emails and asked her to refund but she did not replied.

what I did till now.
1. I raised paypal dispute in first place when I did not receive item after 20 days than she emailed me and sent another replacement and asked me to canceled dispute so I canceled dispute - Now I cant open another dispute.
2. I reported this member to ebay support but nothing has happened.
3. I emailed ebay support and ask them to send me refund - they are suggesting me to go to paypal.
4. I emailed all buyer who bought from this seller ask them to check rayban wayfarer and compare with original, they also found she is selling fake product.
5. Now I am daily send email to refund but she is not replying.

Please suggest what to do next?

Is there any legal action I can take as she scammed many people in ebay.

re paypal you are screwed really, after you have opened a dispute then cancelled it you cannot (I do not think) open another one

However you can send the seller a money request and put in there it is to be compensated for the copy rayban that they sold you, also send the email to security at paypal stating that counterfeit items are being sold and you may have a bit of luck

Obviously on ebay you must leave a negative stating counterfeit , hopefully you are in time to do this

The negative may push the seller to get in touch with you

Otherwise they have gone and are on another account selling the same- so look and see who is selling the same items on new accounts and you may find the same person

No I cant open another dispute for the same item in paypal

I have sent email to security at paypal stating that counterfeit items are being sold but no action has been taken.

I have given her negative feedback and thought she will reply but she is ignoring my emails. she replied once and asked me to return item but did not say anything about refund.

You could sue but that would cost you more than what you spent on the glasses.

send a money request to the email , so at least you have that on record, state in there it is for a refund, then forward that request to paypal security too

the more you bug paypal the more likely they will deal with it

I know this but still I am thinking of general complaint or something that can stop her scamming people. I am from India so I am not aware legal rules of complaint in UK, by the way she is from uk.

Yes I did send money request and daily sent 1 email remainder to ebay team and paypal team. hoping to get good reply from them. $60 is not a big amount for me but still cant allow anyone to scam people.

You're screwed. But call ebay saying she's selling fake. She'll be out but she most likely has several account.

Actually, if you the seller is based in the US, selling counterfeit good it's illegal, it's against intellectual property laws and is a criminal offense.

You can contact the police as they've committed a crime. If they aren't in the US, not a lot you can do as you've already done what you can.

But leave bad rep, etc etc.

I would write to her saying you reporting her to the police.

In the description of the product does it mention it is counterfeit? If so nothing you can do about it.

Although if you paid by card attached to your PP account you can call your bank and do an unauthorized charge back say you didn't auth the payment.

No you're absolutely wrong, as long as you are informing the customers that is it a counterfeit then you're safe. Just like people who sold posters of xbox360 and in the description they write that you're buying the xbox 360 poster not an actual xbox 360, hence they got away with it lol...

No you are totally wrong, if you put in any ebay listing that an item is counterfeit it will be removed in seconds and your account will likely get banned

No you're absolutely wrong! It is against Ebays TOS to sell fake shit period! Like someone else said, they would put themselves out there to have their account banned if there was any mention of it not being authentic.

No, you're wrong. eBay see the word counterfeit or copy and they will stop your auction. Repeat and they will ban you. I know this for a fact. eBay will not risk themselves being sued for allowing counterfeit goods to be traded on their site, they'd be fucking stupid to do that.

There's loads you could do not many would result in gettting your money back though.

You could

• Report her to the police for selling fake gear

• Report her to local trading standards for selling fake gear

• Report her to HMRC for making in income and not declaring or paying tax (eBayers never declare their tax)

• Buy several of the cheapest items she sells, then post enough negative feedback to destroy her account.

Or take a few tips from Anonymous

• Go though phone book and arrange for every pizza company, piano tuner, chimney sweep, plumber to pay her a visit (all at the same day and time)

• Find her on Facebook, create an identical profile, then add all her friends. Then tell her friends what criminal she is.

• Does the local paper allow anyone to write an article and publish on their site? Use her profile pic and some photos from Google Street View and write a nice article.

• Googlebomb

Again, not going to get your money back but might make you sleep at night.

Did you use paypal balance? Or a card? If you ever used a credit/debit card with that paypal, raise a dispute with your card company. It doesnt even have to be for that particular transaction, because when you do that, paypal starts paying attention to you. Or just keep calling them till someone thats nice enough does something about it.

She's done with that ebay account... 8 out of her last 11 feedbacks are negative and all are from different buyers. There is no way that anyone would buy from someone with that kind of recent feedback! She knows it too cause she's got nothing up for sale from that account.
