I suck at reading and understanding TOS. So to keep it simple my question is about people getting the ban on their accounts due to links showing up in forums and blog comments and ebay pages...

Are those links the referral links or your own domain links? I would imagine it is talking about your referral link and not domain links as you could not promote your site otherwise. Now that I type this out I really feel it is the referral link being spammed that is busting people.... Can someone shed some light on this for me?
