Advice on new product launch
Hi guys,
I'm about to launch a new dating product through Clickbank in the next couple of weeks. I've been getting my sales page ready with all my graphics etc. I have just realised though that my branding might be a major problem. My guide shows people how to automate the online dating process across a range of dating sites and because of this I chose to plaster their logos across the 3D eCover for my book as well as the headers etc. on my soon to be launched site.

My question is do you think this is a problem? Will I have to redesign all my graphics or can I just put disclaimers on my page saying I'm not affiliated with any of these brands directly etc.
Would appreciate someone's insight.

I think with a disclaimer, using it as you have is 'fair' and complies with the 'fair use' copyright policy.

Off topic but not sure i like the ecover!
On topic, i think you should take a good read of the new Clickbank Guidelines (see below) and it suggests this is not allowed.

OK, thanks. I'll go ahead with a disclaimer and see if I get through Clickbank's approval process. If not, it wont take me too long to switch out graphics.

You can not use a trademarked or copyrighted image for commercial purposes, even with a disclaimer.
I have experience with this from the Zynga/Farmville lawsuits.

Have you actually read the NEW terms and conditions of being a clickbank vendor i posted above. You clearly cannot do this anymore. I in doubt then ask Clickbank staff themselves. Do not rely solely on answers here from 95% of people who prob never being a vendor or even an affiliate and just 'guessing'.

OK thanks again. I'll be sure to read all their Ts&Cs before I launch. I'm still putting the finishing touches on the course itself, so I'll be sure to make sure everything's ship shape before I submit it for approval.

I'll second this. Images/logos are closely guarded brand identities to these companies (I own one myself) and the big companies will spend a lot of money to stop anyone associating themselves with their brand - as they see it as leeching their success - or effectively claiming credibility through association...
Do not risk it. Most IPR lawyers will not respond well to "I'm sorry - it won't happen again..." They get paid well to make it YOUR problem.

Disclaimers would be good, but if you want to be bulletproof, it is always better to seek a legal opinion.

Clickbank will almost certainly make you remove them in the approval process unless you have written permission from the companies to use them.
