His fatal mistake was to stuff all of his cookies into one EPN account. All he had to do was have set up 15-20 accounts and he'd still be laughing his way to the bank.
I guess his real fatal mistake was that he owns DP and was not a BHW member.

Ouch. Mail and wire fraud, computer fraud and abuse, and a RICO. They're trying to throw the book at them. Someone should tell these guys to file for Chapter 13 (personal) bankruptcy, seeing as how this is a civil case. That should give them "Bankruptcy Protection", and should prevent eBay from being able to get any money out of them, unless the stay is lifted (which it usually isn't). They will, of course, have to give up almost everything they own. And their credit will be fucked for about 7-10 years. But I suppose it's better than paying eBay tons and tons of money in punitive damages for the rest of their lives. I guess it all depends on how rich they are and how much debt they're in. Then again, bankruptcy is hard to file for these days.

It's not really a question whether you can get around it or not. The question is around the repercussions if, and when, you get caught. There will be case law and a precedent set here that change the result from getting caught stuffing move from a simple ban, and losing your last paycheck, to jail time and huge fines.
You can "get around" getting caught robbing banks, stealing cars and email spam too but I think that the risk/reward just got exponentially skewed.

Wow this is fascinating.
I definitely agree it's not so great to wish any ill upon another, even one you're not fond of. It's a little soon I think to be laughing at them and calling them idiots for getting caught (unless you actually happen to know for fact exactly what they are doing). Seems to me like they had some interesting protection measures, for example not stuffing visitors from the cities where eBay and CJ is headquartered. Interesting. I do think they must have gotten a bit sloppy and greedy. Since they got caught, of course their tactics were not enough to cover them at the level they were stuffing.
Is this the first CS lawsuit ever? This could set a major precedence. I'm sure it is a scare tactic. And I'm sure it will work to a good degree for them.
I myself was always a little hesitant to mess with CS, and this helps encourage me to never try. Everyone has to decide what is right for them. To each his own. I'm sure the day is not far off when CS deemed a criminal action. "Intention to defraud" is obvious, it wouldn't take much to make it a felony.
Looks like the greedy folks are gonna ruin it for most of the rest of ya'll.
It'll be interesting to see how much of a judgment eBay is seeking and how it all pans out. I got my money on eBay, LOL.

You know, no matter how much animosity we may share with DP (I personally have never been a member nor spent more than 5 minutes total on that forum) BUT, what is in question here; eBay suing for cookie stuffing effects us directly. I would estimate that there are more than 250 members in here stuffing eBay auctions directly, and about 500 who are stuffing eBay in some form or another. I ruling in eBay's favor directly hurts this forum.
I don't know Shaun from Snap Crackle & Pop, but I'm going to guess he is a Black Hatter not too disimilar than us. Sure he may have founded a less 1337 forum than what we have but, he doesn't DESERVE to mede the martyr. Hell, I've prob made more in the last two months from EPN than he made with CJ's eBay program in two years.

Basically, eBay's last consolidated opposition brief wasn't consolidated enough, so they had to file a motion to let them ramble on for more than the allowed 25 page.
