Is it a crack? Did he sell you his license key?
No he sold me the bot with the key. He said not to take the .exe out of the folder or it will no longer work.

I'm pretty sure that you can get sued just think if your were the creator of something and people was making money on the side selling your product... would you be happy ?![]()

So, basically you're asking if you can re-sell pirated software?!
If it's legitimate software with a legitimate key, and their TOS don't preclude you from selling/transferring the license (many do), and you only sell it 'once' (not copies), then you can resell it.
Not only can you be sued, but it is criminally illegal, as in fines or jail if you are caught.

you will have to say the payment is for site access and that you are not held responsible for any downloads, pretty simple. you may also say that you do not sell software just membership access to your site.

You can get sued for anything. I think it highly unlikely that the creator of a bot is going to put themselves in a court room. They are probably more worried about getting sued themselves by Instagram.

that's a fine example how clueless some people are (not just the OP, but the ebay seller too)
i wouldn't worry about the owners though, i'd rather worry about those who shut the bot down
