This is definitely not an opt-in list. If it was set up where you clearly spelled it out in the email..."By emailing this address, you agree to opt-in to my list"...then you might be okay, but I still don't know if that is considered an opt-in list. You must have time stamp and the ip address that the person opt in with to make it an official opt in list. It would be considered illegal harvesting I think, and is mainly used or certain blackhat techniques.
